This is an agreement (this “Agreement”), between Theatre On Ice of Boston, a program of The Skating Club of Boston ("the Club"), a not-for-profit corporation formed under the laws of the Commonwealth of Massachusetts, having a place of business at 1240 Soldiers Field Road, Boston, Massachusetts, and
[Parent’s name] (the “Parent”). In consideration of the terms and conditions of this Agreement, the Club and the Parent agree as follows:
The Club has extended an invitation to [Skater’s Name] (the
“Skater”), a child of the Parent, to participate in and be a member of Theatre On Ice of Boston (“the Program”) for the 2019-2020 season. The Parent desires that the skater accepts the position on TOI on the terms stated below.
1. The Parent agrees to be financially responsible for all monthly fees (the “Fees”) and other costs and expenses incurred in connection with the Skater’s participation and activities with or as a member of the Program. The annual tuition will be $2,600. For the convenience of the Parent, the Fees may be paid in monthly installments, payable to the Club starting from September 2019 to June 2020. By the Skater’s acceptance of the position in the Program, the Parent agrees and promises to pay all Fees as they become payable. The Fees are non-refundable under all circumstances after October 1, 2019, unless there are an insufficient number of skaters to form a team or the team otherwise does not compete. The Program Contract (defined below) describes those costs and expenses that are included in the Fees and those that are to be borne by the Parent over and above the Fees. All Team members, whether team skaters or alternates, pay the same Fees. The Parent further acknowledges that the Team budget presupposes that all Skaters will pay Fees throughout the season. Withdrawal from the Team after the execution of this Agreement will not be grounds for reduction or refund of any or all Fees previously or subsequently coming due.
2. The Parent acknowledges that the Program is a competitive program, and expressly agrees that no promise or commitment has been made that the Skater will in fact skate regularly in any or all competitions or exhibitions. All decisions as to whether the Skater is skating on the line for practice, performance, or competition or an alternate will be at the discretion of the Coaching Team and Program Management, whose decisions are final, and the Member agrees to abide by such decisions. The Program Management and Coaching Team also determine which competitions and exhibitions to enter, and makes all decisions about the team program, including skater selection, music and choreography, skater placement and costumes.
3. Extensive and detailed information regarding the Team has been provided to the Skater and to the Parent in the Theatre On Ice of Boston Handbook (the"Handbook"). The Parent acknowledges receipt of the Handbook, and has read and understood its contents. By their initials below, the Parent and the Skater agree to comply with TOI of Boston policies and procedures.
4. Consent to Photograph, Film, or Videotape a Skater for Non-Profit Use: I hereby consent to the participation in interviews, the use of quotes, and the taking of photographs, movies or videotape(s) of enrolled skater by employees or representatives of The Skating Club of Boston, Boston Parks Department, and The City of Boston. I also grant the right to edit, use, and reuse said products for the express purpose of promoting The Skating Club of Boston, its Skating Academy, the U.S. Figure Skating Basic Skills Program, Boston Parks Department, and The City of Boston, including use in print, on the internet, and all other forms of media, without any compensation for such use. I also hereby release The Skating Club of Boston, its Skating Academy, the U.S. Figure Skating Basic Skills Program, Boston Parks Department, and The City of Boston and its agents and employees from all claims, demands, and liabilities whatsoever in connection with the above.
5. Failure to pay any Fees or to comply with the policies and procedures set forth in the Program Contract may be grounds for removal from the Program, but the Parent shall remain responsible for the timely payment of all Fees and other costs. The Parent agrees that the Skater will not skate or compete with another team (whether in the same or a different division as the Program) unless all of the Club and Program Fees and other payments have been paid and a written release has been issued by the Program and the Club.
This Agreement is a legally binding contract between Theatre On Ice of Boston and the Parent, and will be construed in accordance with the laws of the Commonwealth of Massachusetts. Each party agrees to comply with all the rules and regulations of The Skating Club of Boston Member Handbook (each of which shall be binding on the parties), including the bylaws.
