2019-2020 Theatre On Ice of Boston Team Contract Minor

This is an agreement (this “Agreement”), between Theatre On Ice of Boston, a program of The Skating Club of Boston ("the Club"), a not-for-profit corporation formed under the laws of the Commonwealth of Massachusetts, having a place of business at 1240 Soldiers Field Road, Boston, Massachusetts, and [Parent’s name] (the “Parent”). In consideration of the terms and conditions of this Agreement, the Club and the Parent agree as follows:

The Club has extended an invitation to [Skater’s Name] (the “Skater”), a child of the Parent, to participate in and be a member of Theatre On Ice of Boston (“the Program”) for the 2019-2020 season. The Parent desires that the skater accepts the position on TOI on the terms stated below.

1. The Parent agrees to be financially responsible for all monthly fees (the “Fees”) and other costs and expenses incurred in connection with the Skater’s participation and activities with or as a member of the Program. The annual tuition will be $2,250. For the convenience of the Parent, the Fees may be paid in monthly installments, payable to the Club starting from September 2019 to June 2020. By the Skater’s acceptance of the position in the Program, the Parent agrees and promises to pay all Fees as they become payable. The Fees are non-refundable under all circumstances after October 1, 2019, unless there are an insufficient number of skaters to form a team or the team otherwise does not compete. The Program Contract (defined below) describes those costs and expenses that are included in the Fees and those that are to be borne by the Parent over and above the Fees. All Team members, whether team skaters or alternates, pay the same Fees. The Parent further acknowledges that the Team budget presupposes that all Skaters will pay Fees throughout the season. Withdrawal from the Team after the execution of this Agreement will not be grounds for reduction or refund of any or all Fees previously or subsequently coming due.

2. The Parent acknowledges that the Program is a competitive program, and expressly agrees that no promise or commitment has been made that the Skater will in fact skate regularly in any or all competitions or exhibitions. All decisions as to whether the Skater is skating on the line for practice, performance, or competition or an alternate will be at the discretion of the Coaching Team and Program Management, whose decisions are final, and the Member agrees to abide by such decisions. The Program Management and Coaching Team also determine which competitions and exhibitions to enter, and makes all decisions about the team program, including skater selection, music and choreography, skater placement and costumes.

3. Extensive and detailed information regarding the Team has been provided to the Skater and to the Parent in the Theatre On Ice of Boston Handbook (the"Handbook"). The Parent acknowledges receipt of the Handbook, and has read and understood its contents. By their initials below, the Parent and the Skater agree to comply with TOI of Boston policies and procedures.

4. Consent to Photograph, Film, or Videotape a Skater for Non-Profit Use: I hereby consent to the participation in interviews, the use of quotes, and the taking of photographs, movies or videotape(s) of enrolled skater by employees or representatives of The Skating Club of Boston, Boston Parks Department, and The City of Boston. I also grant the right to edit, use, and reuse said products for the express purpose of promoting The Skating Club of Boston, its Skating Academy, the U.S. Figure Skating Basic Skills Program, Boston Parks Department, and The City of Boston, including use in print, on the internet, and all other forms of media, without any compensation for such use. I also hereby release The Skating Club of Boston, its Skating Academy, the U.S. Figure Skating Basic Skills Program, Boston Parks Department, and The City of Boston and its agents and employees from all claims, demands, and liabilities whatsoever in connection with the above.

5. Failure to pay any Fees or to comply with the policies and procedures set forth in the Program Contract may be grounds for removal from the Program, but the Parent shall remain responsible for the timely payment of all Fees and other costs. The Parent agrees that the Skater will not skate or compete with another team (whether in the same or a different division as the Program) unless all of the Club and Program Fees and other payments have been paid and a written release has been issued by the Program and the Club.

This Agreement is a legally binding contract between Theatre On Ice of Boston and the Parent, and will be construed in accordance with the laws of the Commonwealth of Massachusetts. Each party agrees to comply with all the rules and regulations of The Skating Club of Boston Member Handbook (each of which shall be binding on the parties), including the bylaws.

The following terms are set forth by both Theatre On Ice of Boston for the 2019-2020 season in the best interest of both the skaters and the team itself.

• I understand that I am required to pay a $100 Team Membership fee to The Skating Club of Boston (or another type of Club membership) and have a valid U.S. Figure Skating registration for my skater.

• I agree to pay a $100 non-refundable deposit to secure my skater’s spot on the team which will be applied to the annual tuition costs.

• I will pay my ice bill in a timely manner, as the Team is notified by the Club when a skater’s bill reaches 60 days or more. If my bill reaches 90 days or more, the Club may prohibit my skater from skating with Theatre On Ice of Boston until balance is paid.

• I acknowledge that as a Theatre On Ice of Boston Team Member, I must sell a minimum of 5 Ice Chips tickets, even if my skater is not skating in the show. The amount of tickets that I do not sell will be billed to my Club account.

• I am responsible for purchasing a team jacket, a CE outfit, 2 team t-shirts for my skater, and have these items in time to use for team functions. Team Managers will let parents know how to place orders for these items. Items will be billed to team member’s Club account.

• I am responsible for my skater’s travel costs to and from competitions, shows, and events, which may include hotel and airfare. I also understand that team members are responsible for the Coaching Team travel costs which is covered in the team fee.

• I understand that when team travel is involved with a hotel stay, that my skater is required to stay at the designated team hotel. Hotels will be selected based on moderate rates and proximity to the competition site. Skaters must arrive and depart for competitions and performances on the appointed dates as designated by the Coaching Team.

• I understand that my skater is required to attend one Send Off Exhibition & Dinner at The Skating Club of Boston prior to TOI Nationals 2020, and that all skaters and families are required to pay for their own dinners.

• I understand that Team Members on Theatre On Ice of Boston are all responsible to maintain the team budget. Team costs will be reviewed monthly by the TOI of Boston Steering Committee and Program Director. Team members will be updated if any unplanned costs are anticipated. Additional costs to be covered by skaters will be charges for videos, photos, buses and hospitality costs as they relate to the TOI Nationals competition.

• If in a volunteer role I incur expenses that require reimbursement that received prior approval by Program Management, I understand that if I do not submit reimbursement receipts by June 30th, 2020, I will not receive any reimbursements.

• I understand that if I have conflicts with any requirements for my skater, I will submit them in writing to the Coaching Team and Program Management and request an exception, and this request will be reviewed. Requests made prior to the start of the season are more likely to be approved than last minute requests due to choreography and limited rehearsal considerations.

• My skater understands he/she needs to follow instructions given by the Program Management and Team Managers who oversee managerial aspects for the teams, including but not limited to, the tracking attendance, U.S. Figure Skating and the Club membership registrations, travel arrangements, team logistics, etc.

• My skater understands he/she needs to follow instructions given to them by the Coaching Team and Club Officials. I will do my best to communicate any concerns or questions I have through the Team Managers.

• I have until October 1, 2019 to withdraw my skater’s Team Membership in writing. If I decide to do this, I must give the team and the Club 30-day notice to cancel any billings. I understand that this does not include the $100 TOI of Boston non-refundable team deposit.

• I will make every effort to have my skater be consistently on time, and I understand that poor attendance may negatively impact my skater’s role on the team. It is expected that my skater will attend all off-ice and on-ice rehearsals, team meetings, and events. A program schedule for the 2019-2020 has been provided to me which I have reviewed.

• I agree to submit required absence requests for approval from the Coaching team to the Team Manager by the Wednesday prior to a practice as outlined in the TOI of Boston Program Handbook.

• I understand that there is a $40 absence fee that will be applied if my skater accumulates more than three (3) excused absences. I also understand if my skater is more than 10 minutes late for practice, they will be marked tardy. Three (3) tardy infractions will be counted as one (1) absence.

• I understand that the Coaching Team will be casting my skater in a part based on multiple factors including dance, animation, acting, skating, previous attendance, team spirit, etc.

• I have received, read, and understand the TOI of Boston Handbook and the TOI Boston guidelines as set forth in the Handbook. I will adhere to those guidelines and will have my skater adhere to those guidelines as set forth in the Handbook.

By entering my electronic signature below, I am committing to skate with Theatre On Ice of Boston for the 2019-2020 season and have read and agree to the terms as set forth in this agreement.
