2019-2020 Theatre On Ice Team Contract Forté

This is an agreement (this “Agreement”), between Theatre On Ice of Boston, a program of The Skating Club of Boston ("the Club"), a not-for-profit corporation formed under the laws of the Commonwealth of Massachusetts, having a place of business at 1240 Soldiers Field Road, Boston, Massachusetts, and [skater’s name] (the “Skater). In consideration of the terms and conditions of this Agreement, the Club and the agree as follows:

The Club has extended an invitation the Skater to participate in and be a member of Theatre On Ice of Boston (“the Program”) for the 2019-20 season. The Skater accepts the position on the TOI of Boston team Forte of Boston in accordance with the terms stated below:

1. The Skater agrees to be financially responsible for all monthly tuition fees (the “Fees”) and other costs and expenses incurred in connection with the Skater’s participation and activities with or as a member of the Program. The annual tuition will be $1,560.00. For the convenience of the Skater, payment for this team can be made either October 2019 to June 2020 making making monthly payment $173 or January to June 2020 making monthly payments $260. Fees paid in monthly installments can be made payable to the Club. By the Skater’s acceptance of the position in the Program, the Skater agrees and promises to pay all Fees as they become payable. There is also a $100 non-refundable deposit due upon acceptance of the spot on the team.

2. The Fees are non-refundable under all circumstances after January 1, 2020, unless there are an insufficient number of skaters to form a team or the team otherwise does not compete. The Program Contract (defined below) describes those costs and expenses that are included in the Fees and those that are to be borne by the Skater over and above the Fees. The Skater further acknowledges that the TOI of Boston program budget presupposes that all Skaters will pay Fees throughout the season. Withdrawal from the TOI of Boston program after the execution of this Agreement will not be grounds for reduction or refund of any or all Fees previously or subsequently coming due.

3. Extensive and detailed information regarding the Team has been provided to the Skater and to Theatre On Ice of Boston Information Packet (the "Packet"). The Skater acknowledges receipt of the Packet and has read and understood its contents. By their initials below, the Skater agree to comply with TOI of Boston policies and procedures as set forth in the Packet.

4. Consent to Photograph, Film, or Videotape a Skater for Non-Profit Use: I hereby consent to the participation in interviews, the use of quotes, and the taking of photographs, movies or videotape(s) of me by employees or representatives of The Skating Club of Boston, Boston Parks Department, and The City of Boston. I also grant the right to edit, use, and reuse said products for the express purpose of promoting The Skating Club of Boston, its Skating Academy, the U.S. Figure Skating Basic Skills Program, Boston Parks Department, and The City of Boston, including use in print, on the internet, and all other forms of media, without any compensation for such use. I also hereby release The Skating Club of Boston, its Skating Academy, the U.S. Figure Skating Basic Skills Program, Boston Parks Department, and The City of Boston and its agents and employees from all claims, demands, and liabilities whatsoever in connection with the above.

5. Failure to pay any Fees or to comply with the policies and procedures set forth in the Packet may be grounds for removal from the Program, but the Skater shall remain responsible for the timely payment of all Fees and other costs. The Skater will not skate or compete with another team (whether in the same or a different division as the Program) unless all of the Club’s and TOI of Boston Program Fees and other payments have been paid and a written release has been issued by the Program and the Club.

This Agreement is a legally binding contract between Theatre On Ice of Boston and the Skater, and will be construed in accordance with the laws of the Commonwealth of Massachusetts. Each party agrees to comply with all the rules and regulations of The Skating Club of Boston Club Rules (each of which shall be binding on the parties), including the bylaws, and the TOI of Boston Information Packet.

The following terms are set forth by both Theatre On Ice of Boston for the 2019-20 season in the best interest of both the skaters and the team itself.

• I understand that I am required to pay a $100 Team Membership fee to The Skating Club of Boston (or have another type of Club membership) and have a valid U.S. Figure Skating registration.

• I will pay my ice bill in a timely manner. If my bill reaches 90 days or more, the Club may prohibit me from skating with TOI of Boston until balance is paid.

• I acknowledge that as a Theatre On Ice of Boston team member, I must sell a minimum of 5 Ice Chips tickets, even if for some reason I am not skating in the show. The amount of tickets that I do not sell will be billed to my Club account.

• I am responsible for purchasing a team jacket, a CE outfit, 2 team t-shirts, and have these items in time to use for team functions. Program Management will let skaters know how to place orders for these items. Items will be billed to team member’s Club account.

• I am responsible for my travel costs to and from competitions, shows, and events, which may include hotel and airfare. I also understand that team members are responsible for the Coaches travel costs which is covered in the team fee.

• I understand that when team travel is involved with a hotel stay, I am required to stay at the designated team hotel. Hotels will be selected based on moderate rates and proximity to the competition site. Skaters must arrive and depart for competitions and performances on the appointed dates as designated by the Coaching Team.

• I understand that I am required to attend the Send Off Exhibition & Dinner at The Skating Club of Boston prior to TOI Nationals 2020, and that all skaters and families are required to pay for their own dinners.

• I understand there maybe additional costs to be covered by skaters such as charges for videos, photos, buses, and hospitality costs as they relate to the TOI Nationals competition if I opt to purchase these items.

• If in a volunteer role I incur expenses that require reimbursement that received prior approval by Program Management, I understand that if I do not submit reimbursement receipts by June 30th, 2020, I will not receive any reimbursements.

• I understand I need to follow instructions given by the Program Management who oversee managerial aspects for the teams, including but not limited to, the tracking U.S. Figure Skating and the Club membership registrations, travel arrangements, team logistics, etc.

• I agree to submit any practice dates that I will be unable to participate in to the Coaching Team upon submittal of my contract. Any additional dates, I will make them aware of as soon as possible.

• I have received, read, and understand the TOI of Boston Information Packet and the TOI Boston guidelines as set forth in the Packet. I will adhere to those guidelines as set forth in the Packet.
